Notice is hereby given that the following Ordinance was Introduced and passed on First Reading on Tuesday, September 15, 2026 at 7:00 P.M.  The Ordinance will be further considered on Second Reading and Final Passage at the Regular Meeting of the Orange City Council to be held at City Hall, 29 North Day Street, Orange, New Jersey on Tuesday, October 20, 2026 at 7:00 P.M. at which time and place all persons who may be interested therein will be given an opportunity to be heard concerning same.  Information regarding remote access to the meeting may be found on the City’s website at www.orangenj.gov. and Council’s website at www.orangetwpnjcc.org.   During the week prior to and up to and including the date of such meeting copies of the full ordinance will be available at no cost and during regular business hours at the Clerk’s office or on the Council’s website for the members of the general public who shall request the same.

AN ORDINANCE OF THE MUNICIPAL COUNCIL OF THE CITY OF ORANGE TOWNSHIP, COUNTY OF ESSEX, STATE OF NEW JERSEY, SUSPENDING IMPLEMENTATION OF THE SCATTERED SITES REDEVELOPMENT PLAN PENDING REVIEW AND CONSIDERATION OF FINAL RECOMMENDATIONS BY THE CITY OF ORANGE TOWNSHIP PLANNING BOARD REGARDING CONTINUED DESIGNATION OF THE SCATTERED SITES REDEVELOPMENT AREA AND/OR THE BULK ZONING STANDARDS APPLICABLE THERETO. WHEREAS, pursuant to the Local Redevelopment and Housing Law (“LRHL”), N.J.S.A. 40A:12A-1 et seq., the Municipal Council (“Municipal Council”) of the City of Orange Township (“City”) designated the following 51 parcels located throughout the City, collectively, an area in need of redevelopment currently known as the Scattered Sites Redevelopment Area:

(collectively, “Redevelopment Area”); and,

 

WHEREAS, on April 15, 2025, the Municipal Council adopted Ordinance 32-2024 approving the Scattered Sites Redevelopment Plan (“Redevelopment Plan”), which established bulk zoning standards for the Redevelopment Area; and,

 

WHEREAS, on June 16, 2026, in response to concerns expressed to the Municipal Council and the City’s Administration by community stakeholders about the need for the Redevelopment Area to exist, the Municipal Council adopted Resolution No. 352-2026WO authorizing the City’s Planning Board, pursuant to N.J.S.A. 40A:12A-6(a), to undertake a study and hold any required public hearings to determine whether any or all parcel(s) within the Redevelopment Area continue(s) to meet the criteria for designation as an area in need of redevelopment, and directing the Planning Board, pursuant to N.J.S.A. 40A:12A-7(f), to prepare any proposed amendments to the Redevelopment Plan as deemed appropriate; and,

 

WHEREAS, the Planning Board is to report its findings and recommendations to the Municipal Council upon concluding its study and any required public hearings relating thereto; and,

 

WHEREAS, the Municipal Council finds that, pending review and consideration of the Planning Board’s findings and recommendations in this context, the City’s interests relative to land use are best served by suspending implementation of the Redevelopment Plan.

 

NOW, THEREFORE BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF ORANGE TOWNSHIP, COUNTY OF ESSEX, STATE OF NEW JERSEY as follows:

 

Section 1 Suspension of Redevelopment Plan.

The Scattered Sites Redevelopment Plan dated May 22, 2024, prepared by Nishuane Group LLC and approved by the Municipal Council on April 15, 2025, through adoption of Ordinance No. 32-2024 in accordance with N.J.S.A. 40A:12A-7, is hereby suspended until such time as the Municipal Council takes further action with respect to same following review and consideration of final recommendations from the Planning Board regarding continued designation of the Redevelopment Area and/or changes to the bulk zoning standards applicable thereto.

 

Section 2 Reversion to Applicable Pre-Plan Standards.

Pending further action by the Municipal Council with respect to the Redevelopment Area and/or the Redevelopment Plan pursuant to Section 1 of this Ordinance, each parcel currently designated as part of the Redevelopment Area (i.e., each parcel expressly identified in the Recitals of this Ordinance) shall hereinafter be governed by the bulk zoning standards and other development regulations set forth under Chapter 210 of the Municipal Code applicable to said parcel immediately preceding the Municipal Council’s approval of the Redevelopment Plan (i.e., as of April 14, 2025).

 

Section 3 Severability of Ordinance Provisions.

Each Section of this Ordinance is an independent Section and any part hereof found unconstitutional, void or ineffective for any cause shall not affect the validity or constitutionality of any other parts hereof.

 

Section 4 Conflicts and Inconsistencies.

All other Ordinances and parts of Ordinances that conflict or are inconsistent with this Ordinance are hereby repealed, but only to the extent of such conflict or inconsistency.

 

Section 5 Effective Date.

Following final passage, this Ordinance shall take effect upon the expiration of 20 days after publication, unless otherwise provided by the Municipal Council.

 

PURPOSE: To suspend implementation of the Scattered Sites Redevelopment Plan pending review and consideration of final recommendations from the Planning Board regarding continued designation of the Scattered Sites Redevelopment Area and/or changes to the bulk zoning standards applicable thereto.
