Notice is hereby given that the following Ordinance was Introduced and passed on First Reading on Wednesday, August 5, 2020, at 7:00 P.M. At the September 1, 2020 regular meeting, the said ordinance was amended by Resolution 362-2020 by adding under 72-3 Hours and Operation – Section C. The September 1, 2020 scheduled public hearing remains open and the amended Ordinance will be further considered on Second Reading and Final Passage at the Regular Meeting via Audio-video conferencing on Tuesday, October 6, 2020 at 7:00 P.M.

AN ORDINANCE TO AMEND AND SUPPLEMENT THE CODE OF THE CITY OF ORANGE TOWNSHIP TO CREATE CHAPTER 72 ENTITLED “COMMERICAL HOURS OF OPERATION – MAIN STREET”.
(Sponsored by Council Member Tency A. Eason).
WHEREAS, on the sidewalks near a variety of late-night commercial establishments on Main Street, as well as other streets in the City of Orange Township, clusters of various groups of individuals have over the years given rise to crime and nuisance; and
WHEREAS, the presence of individuals on the sidewalks and parking spaces near commercial establishments throughout the City of Orange Township have also contributed to littering and obstruction of execution of vital government services such as street cleaning; and
WHEREAS, a determination has been made that it is in the best interests of the City of Orange Township to regulate the commercial hours of operations of certain businesses on Main Street and other locations throughout the City of Orange Township.
NOW, THEREFORE, BE IT ORDAINED by the Municipal Governing Body of the City of Orange Township that the municipal code be amended and supplemented as follows:
SECTION 1.
CHAPTER 72 COMMERICIAL HOURS OF OPERATION – MAIN STREET
- 72-1. Purpose.
The purposes of this chapter in regulating the commercial hours of operation of businesses engaged in retail sales and convenience goods outlets, as defined as below, throughout the City of Orange Township are as follows:
- Decrease the noise and disturbance associated with individuals congregating near businesses engaged in retail sales on Main Street and convenience goods outlets throughout the City of Orange Township.
- Decrease overnight accumulation of litter, which said crowds generate.
- Discourage criminal activities, especially drug-related criminal activities and violent crime, as a result of the gathering of said crowds.
- Prevent the presence of individuals and their vehicles, which obstruct the City of Orange Township, from providing government services such as street cleaning.
- 72-2. Definitions.
For the purpose of this chapter, the following terms shall have the respective meanings assigned to them below:
CONVENIENCE GOODS OUTLET – Any retail establishment offering for purchase primary packaged foods, household items, magazines and newspapers, and limited prepared foods such as sandwiches and salads, for off-premises consumption.
RETAIL SALES – Establishments engaged in the selling or rental of goods or merchandise and in rendering services incidental to the sale of such goods.
- 72-3. Hours of Operation.

A. Retail Sales. Except as otherwise regulated by the City of Orange Township municipal code or other state or federal laws, businesses engaged in retail sales located on Main Street may operate only from 10:00 a.m. to 8:00 p.m. This prohibition shall not apply to Retail Food Establishments (restaurants) as defined in the municipal code of the City of Orange Township and regulated by § 98-6 of the municipal code of the City of Orange Township.B. Convenience Goods Outlets. Except as otherwise regulated by the City of Orange Township municipal code or other state or federal laws, convenience good outlets located throughout the City of Orange Township may operate only from 6:00 a.m. to 12:00 a.m.
C. Paint and Hardware Stores. Except as otherwise regulated by the City of Orange Township municipal code or other state or federal laws, paint and hardware stores located on Main Street may operate only from 6:00 a.m. to 8:00 p.m.
SECTION 2. Inconsistencies
All other ordinances and parts of ordinances in conflict or inconsistent with this ordinance are hereby repealed but only to the extent of such conflict or inconsistency.
SECTION 3. Headings
All headings within this ordinance are for convenience only and are not deemed to be part of this ordinance.
SECTION 4. Effective Date
This ordinance shall take effect after final passage and upon expiration of twenty (20) days following publication unless otherwise provided by resolution of this City Council.
PURPOSE
To regulate the commercial hours of operation of businesses engaged in retail sales on Main Street.
